1. OBJECTIVE

The present document establish the pre-contractual information in regard of the contracts celebrated at distance on the web page medpro.pt, which alludes to the article 4th of the Decreete-Law nº 24/2014 of 14th of February, and the all subdomains/sub-websites. The domain medpro.pt it is property of Sítio Suave LDA, with headquarters in Sesimbra, colective person nº 515 553 654, registered in the Conservatória do Registo Civil/Predial/Comercial of Vila Nova da Barquinha, from now on designated as MedPro.

MedPro reverse the right of modify freely the present pre-contractual information due to adquate it to the aplicable portuguese legislation, without necessity to any pre-warn.

The use of the website medpro.pt, it's subdomains and sub-websites, as well the purchase of any product in such web addresses, as the premise of aceptance of the present informations and the General Conditions of Use presents in this page.

2. TERMS OF USE OF MEDPRO.PT

The user complies to use this website in agreement with the disposed on the portuguese legislation, refraining to use this website for activities against to the law, the moral and the good costumes, or the rights and interests of others.

The website medpro.pt may include links to other websites, in which may contain informations/tools usefull for their users. The present conditions are not aplicable to these other websites. As so, in case the user visits other websites, redirected from our website, the user should read the terms and conditions of that website, as well the Privacy Politics of the same website.

3. CHANGES OF THE PRESENT TERMS

MedPro reserves the right to modify unilateraly at any moment, without any warning, the presentation and the content of the website, it's services and the general conditions of use, with the exception the contracts already celebrated and in execution. These modifications serve the purpose of improvement of the website, improving simultanously the services offered to the user on the website that, in case of desagreement of the alterations, may resolve the contract.

4. INTELECTUAL PROPERTY

All the content and information present in medpro.pt and it's subdomains, are property of MedPro and it's use, reproduction, copy and disclosure by others means of logos, texts, videos, images presented in that website are due to previous authorization.

5. INFORMATION ABOUT PRODUCTS AND PRICES

5.1. Information of Products

MedPro has in consideration the information related to the characteristics essentials to the products through tecnical descriptions shared by it's providers, of the photos that ilustrate the products comercialized, in rigorous respect to the best standards of the market.

5.2. Information of Prices

The prices of sale to the public shown in medpro.pt and it's subdomains are presented in euros. The VAT is included in all the prices shown.

The delivery costs could be responsability of the user and buyer, and added to the total of the price os the selected products. The user will be informed of these costs before confirming the order and before the end of the process of buy. MedPro reserves the right to modify the prices at any moment. However, MedPro commits to aply the taxes and prices shown in the moment of the purchase.

In case of occuring an informatic, manual, technical or any other nature of error, that may cause a substancial modification on the price of sale to public, not foreseen by MedPro, in a way that such difference is unreasonable, extravagant, derisive or ludicrous, the order of buy will be considered invalid and annulled.

The prices of the products available in medpro.pt are valid for orders made only in the website medpro.pt.

MedPro is not responsible for damages due to any informatic virus, network problems, or of the internet supply, informations given by providers or any other foreign situations and that prevent the access and correct functioning of the domain medpro.pt as well the services available.

6. WARRANTY

The products available at MedPro in medpro.pt are covered by portuguese regime of legal warranty, as disposed in the article 5th of Decrete-Law nº 67/2003, of 8th of April, with the modifications introduced by Decrete-Law nº 84/2008, of 21st of May.

Damaged product – You should contact the customer support available in the online store and follow the steps shown.

Returns dut to damage on transport – the client at the time of reception and unpacking, verify any visible damage that may be caused by transport. In case of any damage, the client should not accept the delivery. After signature of the Transport Guide, MedPro is not responsible for any physical damage cause by the carrier.

7. RETURNS AND RIGHTS OF FREE RESOLUTION OF CONTRACT

The user has a term of 14 days (except in the exceptions described below), counting from the day that the user has physical possession of the goods or the day of physical possession of the last item, in case of several itens ordered in one unique order, delivered separately, to return the order, without any reason. In case of digital goods, the term counts on the day that the item becomes available to the user.

Before purchasing an item, have in mind that related to the Contract Resolution (Returns) there are in the Portuguese Law elements that distinguish a purchase at distance (online and receiving on the address via carrier). For purchases at distance, the Portuguese Law establish to the user a term of 14 days (usually known as reflection period) after taking physical possession of the itens, during that time, the user can return the item/itens without need of justification. In case of Free Resolution of Contract, the shipping costs are responsability of the user, as establish on nº 2 of article 13th of Decrete-Law n.º 24/2014, of 14th of February.

MedPro will not accept any return sent with shipping costs due to pay or cash on delivery. MedPro Will reimburse the Client at maximum 14 days after the day of receiving the communication of the Contract Resolution in the terms of article 12th of the decrete-Law n. 24/2014 of 14th of February (Portugal), or the work day after the reception of the return or proof of return, in accordance with the last event occurring.

7.1. Terms of acceptance to exchanges and returns in purchases at distance

Although the goods are accepted to return/exchanges in the first 14 days in puchases at distance (as described above), the goods returned are only accepted in case of respecting scrupulously the following terms:

  • The item returned has to be intact and without any damage or signs of use;
  • The item must be returned along with it’s package, manuals and accessories in pristine condition;
  • Along with the item returned, it must come the receipt in which appears the same item.

In case of infringement of any of this terms, we will not accept the return (and subsequent reimbursement) or exchange.

7.2. Itens not accepted for returns or exchanges

Except in case of technical anomaly, there are some items that can’t be accepted for exchange or returns, due it’s nature (for reasons of hygiene, safety, data transmission, maker recommendations etc).

  • The products of personal hygiene, such as toothbrushes and dental floss will not be accepted.
  • The products that show the safety seals broken will not be accepted.

7.3. Types of reimbursement of returns

In case you request a reimbursement, it will be made via bank transfer for the IBAN that provided at the return request. MedPro will make the reimbursement as soon it’s concluded the technical verification of the item and the compliance of the terms of the returns as described above.
